1. What is it about?
This privacy policy (“Policy”) sets out the basis on which any personal data is processed by us (“Classeek” or “we”) when you visit the website
https://classeek.com (“Website”) or the platform ClasseekLink (“Platform”), which is accessible on
https://apps.classeek.com/ and on the app ClasseekLink (available in particular on the App Store and on Google Play) , and the on-demand video library Insights by Classeek (“Video library”), which is accessible on
https://insights.classeek.com.
When we use the terms “Personal data”, we refer to personal data as defined by the Federal Act on Data Protection (“FADP”). It could be Personal data of anyone (“you”) (i) visiting the Website, (ii) using the Platform or the Video library (“User”), or (iii) about whom there is publicly available data.
Please read the following carefully to understand our views and practices regarding your Personal data and how we will process it.
2. Who is responsible for your Personal data?
Classeek is the data controller for Personal data covered by this Policy. Its headquarters are at Unlimitrust, 46 route des Flumeaux, 1008 Prilly (Switzerland). We may be contacted by email at the address
info@classeek.com and as further indicated in section 9 “Your rights”.

3. Which Personal data do we collect from you and for what purpose?
3.1 When you visit our Platform
When you visit our Website, we may automatically collect the following Personal data:
- information regarding the use of our Website, including language, date and hour of your visit, browser used, location, volume of data transmitted, links you might follow, visited web pages and content, and duration of the visit;
- technical information, including the IP (Internet Protocol) address used to connect your computer to the Internet, the type of device you use, a unique device identifier (for example your device’s IMEI number, the MAC address of the wireless network interface or the mobile phone number used by the device);

In addition, Google Analytics or Google Tag Manager, as developed in art. 5, is used in order to understand your usage patterns and to develop statistics on the latter. This processing is justified by your consent, unless applicable law does not contain any requirement for such consent and that the processing is justified by our prevailing interest to improve our Website, Platform and Video library and their services.
Moreover, if you use paid services, you will be asked to communicate your credit card information and billing address. This processing is justified by the performance of the contract between you and Classeek.
3.2 When you create an account or log in to our Platform or our Video library
When you create an account or log in to the Platform or the Video library, you agree that we process the Personal Data that you share with us.
The User must communicate the following data:
- Name;
- First name;
- E-mail;
- Password;
- Geolocation or place of residence;
- Confirmation that the User is 16 years or older;
- Profile category;
- Preferred instrument.
This Personal Data is collected in order to allow your identification, to ensure that a User creates only one account and to provide you with the services offered on the Platform and the Video library. Its processing is justified by the performance of the contract between you and Classeek.
You can also voluntarily add optional information about you on your account, for example a profile picture, your biography, etc. This processing is justified by your consent.
Moreover, if you ask for paid services, you will be asked to communicate your credit card information and billing address. This processing is also justified by the performance of the contract between you and Classeek.
3.3 When we process publicly available information about you
We may process Personal data about you which is publicly available, even if you are not a User.
Publicly available data includes:
- Name;
- First name;
- Biography;
- Data and metadata related to appearances in the media;
- Any other publicly available data.
This personal data is processed to provide accurate and complete information regarding the classical music community, in particular about current trends and latest news about artists. This processing is justified by our interest and the public interest to have information on public figures.
3.4 When you use services provided by third parties on our Website, Platform or Video library
Some services on our Website, our Platform or our Video library are offered by third parties. When you use these services, we receive information about you in the following cases:
- When you log in to the Platform or the Video library with your social login (for example Google, Facebook or Apple), we receive identification data from the login provider;
- When you donate with Donorbox, which uses Stripe as a payment provider, we receive your identification data relating to both services.
When you pay to watch videos from our Video library, which uses Stripe as payment provider, we receive identification data relating to this payment service.
- When you subscribe to our newsletter, we receive information about your e-mail address.
- When you use the chat to communicate with us, we receive information about your identification data (e-mail, first name, last name), connection time and location, messages written.
4. Who do We share your Personal data with?
4.1 With our data processors
We may share your Personal data with those who provide us with services as data processors, mostly IT service providers, in particular to analyze the traffic on our Website, analyze how visitors browse our Website, allow visitors to manage their cookie preferences, provide a chat messaging service, provide a video on-demand library and send newsletters.
Our data processors are bound by an obligation of confidentiality and are entitled to use your Personal data only in accordance with our instructions and this Policy.
4.2 With third-parties (data controllers)
When allowed or required by law, when it is necessary to defend our interests or with your consent, we may share your Personal data with third parties, for example at the request of judicial authorities, to assert our rights in court or to allow you access to third party services.
Some services on our Website, Platform or Video library are offered by third parties (for example on our Website and our Platform, the integration of videos and of a donation button). If you use them, your Personal data will be shared with those third parties.

7. Security
Classeek takes security matters seriously and makes all the reasonable efforts to ensure the best possible security level according to its means. In this regard, Classeek takes standard security measures, implemented by specialists.
Classeek uses in particular standard technology and security precautions, and organisational procedures to protect your Personal data from unauthorised access, improper use, disclosure, loss or destruction. Industry standard firewalls and passwords protection are also used to protect your Personal data.
8. Data retention period
As a rule, any Personal data that has been collected through the Platform or Video library or transmitted by you shall be deleted within three months after termination of the User’s account, by the deletion of the User’s account content or by the closure of the Platform or Video library, unless a legal obligation obliges us to retain the data for a longer period of time. It is however expressly underlined that these data may be kept even after the termination of the User’s account, the deletion of the User’s account content or the closure of the Platform or the Video library, at least temporarily, in particular (without limitation) in case of back-up systems.
If your Personal data is processed exclusively with your consent, we may process your data during a short period of time after your consent’s withdrawal in order to follow-up your request and to keep a record of your request.
Anonymous information (including but without limitation data collected through the use of Cookies) may be kept without any limitation.
9. Your rights
You are entitled to inquire about the Personal data held by Classeek and to receive a copy thereof, as well as to request an update, rectification, deletion and minimisation of the processing of your Personal data. You may at any time withdraw your consent and have the right to object to the processing of your Personal data, unless a legitimate interest justifying the data processing exists. You also have the right to data portability regarding the data that you have transmitted to us and that are processed with your consent or for the performance of a contract.
You may also refuse any use of your Personal data by Classeek for marketing purpose.

10. How will we let you know of changes to our Policy?

11. Applicable law and jurisdiction
This Policy, as well as all matters arising out or in relation to it (including non-contractual disputes or claims and their interpretation) shall be governed by the laws of Switzerland, to the exclusion of the rules on conflicts of laws.
Any claim and dispute in relation to this Policy (including non-contractual disputes or claims and their interpretation) shall be subject to the exclusive jurisdiction of the Courts of Lausanne, Switzerland.
