The Website displays content about Classeek, classical music and music professionals, such as interviews, live-streamed concerts, pictures, etc.

The Platform is a place where classical music professionals may connect with the entire classic community. It may be considered as a service provider and a professional networking platform for classical music professionals or anyone interested in classical music with access to customized tools and trusted information.

The artists and performers may connect, message, post and share their profiles, references and programs in a way that allows them to increase their visibility to managers and presenters and to facilitate the exchanges. They may publish their own content on the Platform.

The Video library offers paid, on-demand, educational videos about classical music. When you visit the Website, or use the Platform or the Video library you are considered as a User (“User”, “you”) in the meaning of these Terms of Use.

These terms of use (“Terms of Use”) set out the legal terms and conditions on which Classeek allows you to access and use the Website, Platform and Video library. By accessing, browsing or otherwise using the Website, Platform and Video library, you acknowledge that you have read and understood these Terms of Use and you agree to be bound by them and to comply with all applicable laws and regulations. You warrant that you have the legal capacity to enter into these Terms of Use. If you do not agree with these Terms of Use, you shall immediately refrain from visiting the Website or using the Platform or the Video library.

Classeek reserves the right to make any changes to these Terms of Use, at its sole discretion. The continued use of the Website, Platform or Video library, with or without having expressly accepted the new Terms of Use, shall constitute consent. If you do not agree to such changes, you have no right to use the Website, Platform or Video library and must immediately cease use of it. You are responsible for regularly verifying these Terms of Use in their current version, an up-to-date version of which may be retrieved at any time on the Website, the Platform or the Video library.

By using the Website, Platform or Video library, you acknowledge that Classeek may collect, process and use personal data about you. Such information collected shall only be used in accordance with the Privacy Policy, available at https://classeek.com/company/privacy

You are entitled to visit the Website and use the Platform and the Video library only in conformity with the laws of Switzerland and any other laws that apply. You may solely make legal use of the Website, Platform and Video library and any illegal or inappropriate use of them is banned.

In particular, you agree not to do any of the following in connection with the Website, Platform and Video library:
- upload, post, transmit, distribute or otherwise make available any material that contains software viruses or any other computer programs that may harm the Website, Platform and Video library or the interests or property of other users or of Classeek;

- record, copy, modify, scrape or distribute rights or content from the Website, Platform or Video library in any way;

- use any content or information of the Website, Platform or Video library to compete with Classeek;

- commercialise any code or information or software associated with the Website, Platform or Video library;

- access, or try to gain access to, data contained in a non-public part of the Website or the Platform without having been granted the right to use it;

- use the Website, Platform or Video library in any way that, in the sole judgment of Classeek, is objectionable, illegal, inappropriate or which restricts or inhibits any other person from using the Website, Platform or Video library, or may harm or make liable Classeek or its users;

- use or attempt to use another's account or create a false identity;

- provide misleading or deceptive information;

- share false information or use the Platform to shock or intimidate others;

- share pornographic or violent content on the Platform;

- facilitate or assist another person to do any of the above acts.

You shall compensate Classeek and/or its employees for any claim, costs, damage or expense (including lawyer or judicial fees) resulting from your behavior, in particular (i) your use of the Website, Platform or Video library, (ii) any breach or non-fulfilment of an obligation contained in the present Terms and conditions and (iii) any other cause resulting in a damage to Classeek.

Intellectual property rights, such as brands, logos, designs, photos, videos, domain names and all other property rights in the content available on the Website, Platform or Video library are the exclusive property of Classeek and its licensors. This includes rights to all softwares associated with the Website, Platform or Video library. Nothing in these Terms of Use constitutes a transfer of any intellectual property rights.

Classeek grants you a limited, non-exclusive, non-transferable, and revocable license to use the Website, Platform and Video library for your personal, non-commercial use, and to display the content of the Website, Platform and Video library on your computer screen or on other devices (such as smartphones or tablets), subject to the compliance with these Terms of Use. All other uses are prohibited without Classeek’s prior written consent.

If you publish content on the Platform, you grant Classeek an unlimited, non-exclusive and non-revocable license to use, display and modify the content published.

If you have created and made available a press kit on your account, you grant anyone who downloads it, including Classeek, an unlimited, non-exclusive and non-revocable license to commercially use, display and modify the content of your press kit.

The use of the Platform and Video library requires opening an account, all information being subject to the Privacy Policy.

You must ensure that the personal information given for the registration process is accurate, complete and respects in all aspects the Terms of Use. The information must be kept up-to-date.

The creation of an account and the use of the Platform and the Video library is reserved to people who are 16 years or older. When opening an account, you shall confirm that you meet this age threshold.

The account is secured by a username and a password. You may not communicate your login information to any third party. You are solely responsible for any use of your login information, including by third parties. In case of such misuse or any doubt of such misuse, you must inform Classeek immediately. It is your responsibility to sign out from your account at the end of its use.

The email address chosen for the registration process shall be used by Classeek to communicate with you in any case Classeek would consider useful in its sole discretion. Any email sent by Classeek on this email address shall be deemed well received and notified.

You have the possibility to create a press kit on your account, which can be downloaded by other users of the Platform. You guarantee that the content of the press kit can be used for promotional and commercial purposes by anyone who has downloaded it and that no rights of third parties (in particular Intellectual Property rights) prevent or limit such a use. You shall compensate Classeek and/or its employees for any claim, costs, damage or expense (including lawyer or judicial fees) in case the download and/or subsequent use of the press kit’s content breaches any third party’s rights.

Classeek may block, terminate or suspend any account or ability to use or access the Platform or Video library, in whole or in part, without notice and at all times, at the sole discretion of Classeek, as well as close the Platform or Video library. If you have been blocked from the Platform or Video library by Classeek or if the account has been terminated by Classeek, for whatever the reason, you may not register for a new one, unless Classeek agrees to this in writing.

You may terminate your account at any time by accessing the settings on the account settings tab. Your access to, use of, or participation in the Platform and Video library, including any content therein, may be prevented by Classeek at any time after the termination of the account.

No reimbursement of any paid amount will occur in case of the closure of an account or of the Platform or Video library.

The use of the Website and the Platform is free.

Accessing videos on the Video library is a paid service. Users can get access to a set of videos against a one-time payment. The videos can then be watched any number of times on the Video library. The payment is not refundable. Classeek can also give out promo codes at its sole discretion, which shall only be used by the User who received them and are not transmissible. Classeek uses Stripe as a payment provider and the terms and conditions of this third-party apply when you make a payment.

Additional services may be offered for a fee. The condition of use and payment modalities for those paid services are indicated in specific conditions that are available online when using those services.

You are deemed to know the risks related to the use of the Internet. However, Classeek takes security matters seriously and makes all the reasonable efforts to ensure the best possible security level according to its means. In this regard, Classeek takes standard security measures, implemented by specialists.

Within the limits of the law, Classeek excludes all and any warranty, guarantee and responsibility in relation to the Website, Platform and Video library.

In particular, Classeek does not give any warranty in relation to the content of Website and the Platform, should it be its availability, accuracy or lawfulness. Classeek does not warrant that the Website, Platform and Video library will be available at all times and expressly reserves the possibility to discontinue their availability without notice.

Classeek shall not be liable for any damages of any kind, including loss of income or data, suffered by you or any third party, by act of Classeek or of a third party.

You may not transfer any of your rights or obligations under these Terms of Use without Classeek’s prior written consent.

Classeek may transfer all of its rights and obligations under these Terms of Use without your prior consent, including any personal data, in order to ensure the continued operation of the Website, Platform or Video library.

If any provision of these Terms of Use is found to be invalid by a court or competent jurisdiction, that provision only will be limited to the minimum extent necessary and the remaining provisions will remain in full force and effect.

These Terms of Use, as well as all matters arising out or in relation to them (including non-contractual disputes or claims and their interpretation) shall be governed by the laws of Switzerland, to the exclusion of the rules on conflicts of laws. Any rights, in particular consumer rights, that may apply to you under the mandatory laws of your country of residence are reserved.

Any claim or dispute in relation to these Terms of Use (including for non-contractual disputes or claims and their interpretation) shall be subject to the exclusive jurisdiction of the Courts of Lausanne, Switzerland.
